1 The plaintiff in error, John Roy Savage, hereinafter referred to as defendant, was charged in the district court of Tulsa County by information with the sale of "15,169 grains of Positive, Manicured, High-grade Marihuana for smoking purposes", to one Robert Grimes for the sum of $475 cash, said sale being on July 26, 1955. Defendant was tried before a jury, found guilty and his punishment assessed at six years confinement in the Oklahoma State penitentiary.
